Orbz is hosted by ComicGenesis, a free webhosting and site automation service for webcomics. In the run of Orbz, I have used many images and referenced a good deal of copyrighted material. It is assumed and acknowledged that foreign material is under appropriate laws and to appropriate entities. Use of such material has not been explicitly authorized; however, its use is permissible under  the Copyright Act of 1976, 17 U.S.C. § 107, of which the relevant four-part test is reproduced below. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; the nature of the copyrighted work; the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and the effect of the use upon the potential market for or value of the copyrighted work. 1. The purpose of the use of any copyright material, regardless of whether such use was intentional or not, is for the creation of humour, or at least entertainment, in the webcomic medium. As the author, I derive no profit from its use; Comic Genesis recieves compensation from the sale of advertisments, which is used to pay for infrastructure costs. 2. The nature of the copyright work is, in the majority of instances, limited to a low-resolution image or reference. 3. Both due to the size limitations of a webcomic and the reluctance to lift material wholesale from other sources in favour of original material, any copyright material used will inevitably be either of low resolution or a tiny fraction of the work as a whole. 4. I would be greatly surprised if enough people read this webcomic to make any impact whatsoever on the sale of anything. It is acknowledged that the fair use justification above is intended as a blanket statement to cover all use in the webcomic.
